Entire Agreement:

Affiliates must not send unsolicited emails and must comply with any SPAM Act/s and any applicable laws in your jurisdiction. Affiliates must not register and/or use domains with the wording: "The Shy Girls Hustle”, “The Side Hustle Academy”, TSGH, TSHA, or any of its other properties or any
similar term contained within such domains if they are used in any way to promote the course without explicit consent from the content owner.
Affiliates must not disparage or misrepresent The Shy Girls Hustle, The Side Hustle Academy or any of its other properties in any way, in particular using words like "scam" or "rip-off". Affiliates must not
promote The Course, or any of its other properties on or through any sites with inappropriate content, as determined by The Shy Girls Hustle. Affiliate is deemed to have accepted the terms of this Agreement if they are participating in the Affiliate Program by sharing their affiliate link. Sharing of Affiliate Links is deemed acceptance of all terms and conditions. Violation of these terms may result in forfeiture of commissions earned. As an Affiliate, you are solely responsible for the results of your actions.
INTRODUCTION
What does an affiliate do?
An Affiliate is a an individual who promotes the Course (The Side Hustle Academy).
How does this affiliate program work?
To participate in the Affiliate Program, you will receive an Affiliate Link. An "Affiliate Link" is defined as a web URL or hyperlink that contains (either within the link or via any redirect or link-cloaking software) the Affiliate's ID with the intention of tracking referred traffic to The Course or any of its properties. When an Affiliate directs or sends a prospective buyer to the related website(s), or any of our other properties via a correctly formatted Affiliate Link and that visitor then purchases a product from The Shy Girls Hustle, the Affiliate will receive a commission on the sale of that product (the "Commission"). All
Commissions are paid in US dollars.
The period in which sales are traced back to the Affiliate is 30 days.
PAYMENTS
We run a monthly cycle payment term to protect you and us. We start paying affiliate
commissions no sooner than 30 days after the end of the month that consumers purchase through your
link. Please expect your payouts 45-75 days after the sales you have earned commissions on. All payouts are made via PayPal transfer using your email address associated with your affiliate account. It is your responsibility to ensure you have Pay Pal set up and the correct email address is provided. The Shy Girls Hustle is not responsible for any lost commissions due to incorrect information provided by the Affiliate.
There is a $100 minimum payout threshold before payments will be made. For example, if you have two sales that total $88 in payout commissions owed to you, we will not see this in our system as a payout.
Taxes
You acknowledge and agree that you are solely responsible for compliance with all applicable local, state, and federal tax laws and regulations pertaining to any and all earnings or income generated through your participation in this program. No tax withholdings shall be made by us on your behalf. All Affiliates operate as independent contractors and must manage their taxes as such. It remains your exclusive obligation to accurately report and remit any taxes owed to the appropriate tax authorities. Failure to do so may result in penalties or legal action against you, for which we shall bear no responsibility.
Chargebacks
If we are charged back (due to a customer refund) at any time up to 13 months from the date of sale, we charge you back for that Commission.
AFFILIATE RESPONSIBILITIES
Providing correct information. You, the Affiliate, hereby acknowledge and agree that it is your sole responsibility to provide accurate and current contact information at the time of your purchase and registration for the Affiliate Program. You further agree to maintain the accuracy of such information for the duration of your participation in the Affiliate Program. Failure to provide or maintain accurate contact information may result in the suspension or termination of your Affiliate Program account, as we may be unable to communicate with you regarding critical matters pertaining to the Affiliate Program and your involvement therein. For the purposes of remuneration, you are required to provide accurate
PayPal account information. We disclaim and do not accept any liability for funds transferred to incorrect accounts due to your erroneous input of information. While we may conduct periodic audits of the data and endeavor to notify you of any discrepancies we become aware of, we are not responsible for any errors on your part. You further acknowledge that payments may be delayed by up to six (6)
months if you provide incorrect information or fail to update your account when your information changes. Should you make any updates to your contact or payment information, you are required to notify us immediately via email to ensure that your data is accurately updated in our system.
In the event that you become aware of any inaccuracies in the contact information provided to us, or if your contact information becomes outdated, you are obligated to promptly notify us and furnish the correct and updated information. Failure to do so may result in delays or forfeiture of any payments
due to you under the Affiliate Program.
Username and password
Your login credentials (username and password) are personal to you. You must always maintain confidentiality and not disclose them to any third party. You agree that you are solely responsible for any use of our products or any of our other properties by any person using your username and password. You
agree to indemnify The Shy Girls Hustle against any claims arising out of your failure to maintain the confidentiality of your username or password. You agree not to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with any person or entity. The Shy Girls Hustle or any of our other properties will not be liable for any loss you may incur as a result of someone else using your password or account (either with or without your knowledge). You agree to notify us immediately of any unauthorized use of your account or any other breach of security so we may attempt to remedy the
situation in our platform.
Prohibited Actions
You agree to not:
- Misrepresent The Shy Girls Hustle, The Side Hustle Academy, or any of our other properties, products, or services. Disparage any of our products, including, without limitation, any references to The Side Hustle Academy, or any of our other properties using the words "scam," "rip-off," or any words with a similar or
associated meaning in any advertisement or website copy. Engage in any conduct that is likely to impair or cause damage to the operation of The Side Hustle Academy whether by way of a virus, corrupted file, or through the use of any other software or program.
- Promote The Side Hustle Academy in any way as a "money making", "get rich quick" or similar opportunity. Make income claims or show any income earnings from being a part of the Affiliate Program. This includes implying that you earned money in any way because of the Affiliate Program. Please note we have a zero-tolerance policy for income claims. If you imply earnings, show earnings, or make it seem like people can make money with the course, your affiliate account will be terminated and pending commissions forfeited. If you have any questions, you can contact us via email.
Affiliate is also expressly prohibited from making any express or implied claims that The Course provides a business opportunity, franchise opportunity, a “business-in-a-box,” or an assisted marketing plan.
Spam
You agree to comply with all SPAM Acts. We have a zero- tolerance policy towards SPAM or any Affiliate associated with SPAM. If, at our absolute discretion, we establish that you are involved with SPAM in any way, including creating, sending, or otherwise distributing SPAM, we may immediately terminate your Affiliate Program account, and you will forfeit all Commissions owed to you.
Affiliate link
You are hereby irrevocably acknowledge and agree that you are solely and exclusively responsible for the accurate setup, configuration, and maintenance of your unique Affiliate Link in association with the Affiliate Program. It is your unambiguous obligation to ensure that your Affiliate Link is correctly formatted and configured in strict accordance with the guidelines, protocols, and specifications as may be provided by The Shy Girls Hustle or its authorized agents, for the purpose of accurately tracking any commissions that may be due to you. The Shy Girls Hustle and The Side Hustle Academy expressly disclaims any and all liability, whether direct or indirect, for your failure to receive any commissions or other remunerations that may be associated with the Affiliate Program, arising out of or in connection with any errors, omissions, or inaccuracies in the formatting or configuration of your Affiliate Link. You understand and agree that The Shy Girls Hustle shall not be held accountable for any losses, damages, or forfeitures, whether financial or otherwise, that may result from your failure to properly set up, configure, or maintain your Affiliate Link in compliance with the provided guidelines and specifications.
By your participation in the Affiliate Program, you unequivocally acknowledge that it is your sole responsibility to regularly review, adhere to, and implement the guidelines and specifications related to the setup and maintenance of your Affiliate Link. Failure to comply with these requirements may result in the forfeiture of any commissions or other benefits that may otherwise be due to you under the terms and conditions of the Affiliate Program.
You agree to receive email or other electronic communications from us, including but not limited to newsletters, site updates, promotion resources, and other announcements and correspondence. You agree that all electronically-sent agreements, notices, disclosures, and other communications that we provide satisfy any legal requirement that such communications be in writing. We accept no responsibility for the accurate receipt of any such emails and you are responsible for ensuring that your email address is not blocked or impaired in any way, including by ensuring 'white-listing' of
our email address. If you unsubscribe from receiving our emails, you acknowledge and understand that you may no longer receive information or updates from The Shy Girls Hustle, related courses, or any of our other properties.
PURCHASING ON BEHALF OF OTHERS
Affiliates may purchase The Side Hustle Academy on behalf of others or ‘gift’ the course to others only with the Consent of the receiving party. The only method in which this is approved is that the Affiliate collects the details required to join (including but not limited to full name and email address) with written consent of the receiving party. The affiliate must use their own funds to purchase the course in full. The affiliate will receive their commissions paid as per the standard payout terms in this agreement. No refunds will be made of the remaining moneys paid by the affiliate from The She Girls Hustle and are the sole expense of the Affiliate.
The Shy Girls Hustle accepts no liability for the transaction made by the affiliate on behalf of others. The Affiliate must ensure they follow all laws they are bound to in their jurisdiction regarding the collection of personal data. By doing so the Affiliate ensures that they have sought consent from the recipient to receive communications from The Shy girls Hustle including but not limited to products other than The Side Hustle Academy.
The Affiliate remains liable for any privacy breech that arises from the recipient claiming they have received unsolicited advice from the recipient and all legal liabilities will become the responsibility of the Affiliate.The Shy Girls Hustle take no responsibility for any such complaints and they will remain the responsibility of the Affiliate.
The Affiliate must also ensure that the recipient has also been provided a copy of these terms and conditions and agrees to them before purchasing the course for or on behalf of the recipient.
INTELLECTUAL PROPERTY (IP)
Ownership
We reserve all rights in and to our trademarks, service marks, copyrights, and other intellectual property rights that may subsist in our websites, including text, illustrations, photographs, video, music, sounds, layout, designs, content, belonging to or any of our other properties or to our "IP". You must not use, copy, modify, adapt, reproduce, store, distribute, print, display, perform, or publish any of our Intellectual Property except as expressly provided in this Agreement or with prior written consent
from us.
Modification and Display of IP
You are not permitted to make any changes to any of our Intellectual Property, including, without limitation, the logos and images from our website or course materials. You must not display such items in any way that might be deemed distasteful, or that defames or misrepresents The Shy Girls Hustle, any of our other properties, or the Affiliate Program.
Use of IP
You may use the particular logos and images to which you have been given access to within the "Affiliate Resource" section of the course or related communications for purposes related to your participation in the Affiliate Program only.
You may NOT:
Download our videos and/or re-post them on YouTube, other video-sharing sites, or anywhere else. Download our PDFs and/or distribute them anywhere.
Use any content, testimonials or screenshots from any courses, Facebook
Groups, UNLESS it is your own information that you have personally shared with the group.
Brand Name
You are not permitted to purchase, bid on, or otherwise attempt to acquire any
"The Shy Girls Hustle” or “The Side Hustle Academy” brand name keywords with respect to
Internet search engines; create or use any Facebook pages with these brand name or URL; or register or use domains that include the wording "The Shy Girls Hustle, “The Side Hustle Academy" or any similar wording in the root part of the domain (between the "www" and "com/net/etc." This includes miss-spellings, keywords or any abbreviations on the wording.
GUARANTEES, LIABILITY, AND DISCLAIMERS
Warranties
While we endeavor to ensure that our website content is free from errors, we do not give any warranty or other assurance as to the accuracy, completeness, timeliness or fitness for any particular purpose of the material appearing in our course or any of our other website properties beyond reasonable

TERM AND TERMINATION

This Agreement is effective immediately upon your acceptance of this Agreement and shall continue until terminated as described in this section. Acceptance is deemed as purchasing The Side Hustle Academy and sharing your Affiliate Link.
Changes
These terms will be updated from time to time, and you agree to accept these new changes, and that they will change, including compensation amounts, payment timelines, etc.
Termination
Both parties to this Agreement reserve the right to terminate this Agreement at any time without notice. In the event of termination of this Agreement, all outstanding Commissions due to Affiliate will be payable, so long as the necessary refund period has passed. In the event of a chargeback, all monies will be invoiced to Affiliate. All confidentiality and non-disclosure agreements survive the termination of the Affiliate relationship. In the event we terminate this Agreement due to a breach by the Affiliate, the
Affiliate shall not be entitled to any outstanding Commission payments.
MISCELLANEOUS
Independent Contractor You are acting as an independent contractor when acting as an Affiliate. No partnership, joint venture, or legal entity is created between the parties to this Agreement.
Amendments
We reserve the right to amend this Agreement as needed from time to time. You are bound by any changes made to this Agreement and your acceptance of any income through or due to the Affiliate Program will be regarded as acceptance by you of any changes to this Agreement. We will endeavor to
inform you of any changes made to this Agreement via email.
Advertisements
We do not necessarily endorse or recommend any of the goods or services advertised on or through our websites. We do not necessarily endorse or recommend any affiliates using our services.
Third-Party Websites
Our websites provide links and pointers to Internet sites maintained by third parties. Such linked sites are not under our control and we are not responsible for the contents (including the accuracy, legality or decency) of any linked site or any material contained in a linked site. We will not be liable for any
damages or loss arising in any way out of or in connection with or incidental to any information or third party service provided by any third party.
Confidentiality
You shall keep confidential the terms of this Agreement and any information associated with the Affiliate Program subject to any disclosure required by law. This clause shall survive termination of this Agreement. You agree to use the information, materials and communications provided by this Affiliate Program ONLY for the sole purpose of selling Our products. If you willfully and wantonly violate this clause, We reserve the right to file a complaint against you asking for realized damages, as well as liquidated damages up to $10,000.00 USD per willful and wanton violation. Such a violation is defined as
each and every communication you distribute publicly or privately that misappropriates the materials provided by this Affiliate Program.
Governing Law
This Agreement is governed by the laws of Western Australia, Australia.
AFFILIATE BRANDING
You are permitted to use our brand names and logos as described below, but you MUST follow our usage and placement rules as detailed below.
Usage Rules
Make it clear that you are a Third Party, in no way employed by us, and that your website/blog is in no way owned, operated, maintained or otherwise directly associated with The Shy Girls Hustle or The Side Hustle Academy (for example, by including a statement to that effect prominently on your site). Only use Logos provided in the Affiliate Resources provided in the Course Area.Do not stretch, change the colour of, or in any way recreate or alter our logos. Include copyright with each brand logo usage. Refrain from foul language or profanity.
Domain Names
You may NOT use any of our brand names or variations thereof within a domain name. You are permitted to use our brand names on your personal website/blog provided you follow our usage and placement rules above.
Professional Conduct: Affiliates are expected to maintain a high standard of professionalism when promoting our products.
SOCIAL MEDIA ACCOUNTS
